Cette loi est mise en \u0153uvre par la Occupational Safety and Health Administration (Cal\/OSHA) et s\u2019applique de mani\u00e8re \u00e9tendue aux employeurs concern\u00e9s, avec des exceptions limit\u00e9es.<\/p>\n<h5><strong>Qui est un employeur concern\u00e9 ?<\/strong><\/h5>\n<p>SB 553 s\u2019applique \u00e0 tous les employeurs de Californie, <em>sauf<\/em> si les employeurs, employ\u00e9s ou lieux de travail remplissent l\u2019un des crit\u00e8res suivants :<\/p>\n<ul>\n<li>Lieux de travail o\u00f9 (i) moins de 10 employ\u00e9s sont pr\u00e9sents simultan\u00e9ment, (ii) le lieu de travail n\u2019est pas accessible au public, et (iii) le lieu de travail respecte l\u2019obligation d\u2019\u00e9tablir et de maintenir un Injury and Illness Prevention Program (IIPP) efficace conform\u00e9ment \u00e0 Cal. Code Regs. tit. 8, \u00a73203 ; ou<\/li>\n<li>Les employ\u00e9s travaillent \u00e0 distance depuis un lieu de leur choix qui n\u2019est pas contr\u00f4l\u00e9 par l\u2019employeur ; ou<\/li>\n<li>Certains \u00e9tablissements de sant\u00e9, services de police et \u00e9tablissements correctionnels selon les dispositions du texte.<\/li>\n<\/ul>\n<p>Si votre organisation ne rel\u00e8ve pas d\u2019une exemption sp\u00e9cifique, elle est consid\u00e9r\u00e9e comme un employeur concern\u00e9 et doit se conformer \u00e0 SB 553.<\/p>\n<h5><strong>La date limite de conformit\u00e9 initiale est pass\u00e9e.<\/strong><\/h5>\n<p>Depuis <u>le 1<sup>er<\/sup> juillet 2024<\/u>, tous les employeurs concern\u00e9s doivent : (i) \u00e9tablir et mettre en \u0153uvre un Workplace Violence Prevention Plan (WVPP) \u00e9crit ; (ii) fournir une formation efficace aux employ\u00e9s sur le WVPP, notamment lors de l\u2019apparition de nouveaux risques ou de modifications du plan ; (iii) tenir un registre des incidents violents ; et (iv) cr\u00e9er et conserver les documents relatifs \u00e0 la formation, aux enqu\u00eates sur les incidents et aux mesures correctives (la plupart pendant au moins cinq ans).<\/p>\n<p>Si votre organisation n\u2019a pas encore entrepris ces d\u00e9marches, elle doit agir sans d\u00e9lai. Cal\/OSHA a le pouvoir d\u2019inspecter les lieux de travail, d\u2019\u00e9mettre des citations et d\u2019imposer des amendes \u2013 allant de quelques centaines \u00e0 plusieurs dizaines de milliers de dollars par infraction, selon la classification (g\u00e9n\u00e9rale, grave ou volontaire).<\/p>\n<h5><strong>Exigences annuelles de conformit\u00e9 \u00e0 venir.<\/strong><\/h5>\n<p>Les employeurs concern\u00e9s doivent d\u00e9sormais se pr\u00e9parer \u00e0 respecter la premi\u00e8re \u00e9ch\u00e9ance annuelle.
